Defective Product Liabilities
Defective and even dangerous consumer products are a regular subject of Phoenix personal injury cases as hundreds and hundreds of people are injured every year.
A practical consequence in the law occurs when defective products are sold to the public. Ordinarily, a Phoenix personal injury case must show that the negligent actor, or the careless person's action led to the third party injury. How then, can an ordinary consumer show that in their particular injury, a manufacturer and/or seller was negligent in a particular instance. From a legal perspective, this is hard to prove. Therefore, in the area of product liability, the legal rules concerning who is responsible for a defective or dangerous product is different than typical personal injury law. It is called strict liability.
Because of the inherent legal challenges in product liability cases, strict liability law allows an injured party to win her case much easier. In strict liability, if she was injured by a consumer product she is entitled to compensation from either the business that sold the product or from the manufacturer who made the product.
It should be noted that the principle of strict liability in parties it operates against a nonmanufacturer only if it is in the regular business of selling those particular kinds of products.
