Passenger Liability
If a Phoenix personal injury client is a passenger in an auto accident, they may have several options.
A passenger may file an injury claim under:
- The coverage of the owner or driver of any vehicle involved, and/or,
- The liability insurance coverage of the owner or driver of the car the passenger was in at the time of the accident
- If either driver was using a car belonging to another party, the passenger victim my receive compensation from the insurance company of said owner's vehicle
A Phoenix personal injury passenger accident victim in any case cannot collect from both drivers and owners any more than the total claim is worth. However, if one driver or owner does not have enough insurance coverage, as it relates to total damages of the passenger, the passenger victim can make up the rest against another party.
In the initial post accident stage, the passenger victim may be able to file a claim against the medical payments coverage of their own owner's or driver's insurance policy. This is because medical payment coverage is not based on liability and does not require any legal assessment with insurance companies as to who was at fault.
It should be clarified though that medical payment coverage does not include compensation for pain and suffering, lost income or the like.
