Types Of Injuries

One of the more challenging areas' of Phoenix personal injury law is determining the amount of compensation, specifically, putting a dollar amount on an accident victim's pain and suffering.

As one might expect, the more painful the injury, the higher the ultimate damage amount. In order to standardize the process of assigning pain and suffering damages to dollar amounts in Phoenix personal injury cases, insurance companies connect types of injuries with levels of pain. What is problematic with this reasoning is the fact that types of injuries and levels of pain do not always correspond consistently. For instance, a sprained ankle might end up hurting more than a cracked ankle bone.

Whenever an accident victim has received a diagnosis by a doctor that goes beyond a sprain, bruise, or strain, the injury will be considered more serious than the former mentioned injuries. Similarly, in a wound case, if the injury can be appropriately medically classified as a tear or gash and if the treatment included stitching said wound, the injury is more significant than a typical wound and justifies additional pain and suffering compensation.

Finally, displacement of a spinal disk or the space between the vertebrae is certainly more serious than the typical diagnosis of a strained neck or back.
