Uninsured Claims
Uninsured motorist coverage allows a vehicle owner to be compensated for property damage to their vehicle in the instance where the party causing an accident does not have insurance.
In order to receive compensation in an uninsured scenario in a Phoenix personal injury case, it must be demonstrated that the uninsured was to some degree at fault for the accident. If the Phoenix personal injury claim can establish that the uninsured was completely at fault for the accident, the injured party will be able to collect the full damages amount. The property damage compensation may be reduced by the degree of fault on behalf of the injured party.
It should be noted that, in the event that an injured party is determined to be eligible to collect from both the uninsured motorist property coverage and a relevant collision policy coverage, the uninsured motorist coverage part will apply any deductable owned under the corresponding collision policy coverage. In addition, collision coverage only applies to cars that are moving or are hit by another car when they are not moving, all other damage is excluded under a collision policy.
In the instance of vandalism, the insurance policy which covers this is not under collision, but under a separate policy commonly referred to as comprehensive insurance coverage.
